Objective of the Shodh Charcha: The objective of the Shodh Charcha Law Lecture Series—Episode 09 was to analyze key differences and similarities between these two legal frameworks, with a particular focus on procedural changes related to arrest and investigation.
Participating Students: Students from various colleges/Institutes/University Joined through online link participated through registration and submission of business ideas.
Shodh Charcha 2.0 Law Lecture Series—Ep09 was held on 27th July, 2024. The session was organized by Maharishi Law School in coordination with IQAC. The session featured esteemed guest Sh. Gaurav Mahindra, Founder of Mahindra Law Academy, Prof. (Dr.) K.B. Asthana (Dean MLS), alongside faculty coordinator Saumya Shukla (Assistant Professor), Riya Koul (Assistant Professor), and student coordinator LB Kiran (LL.B. 2nd year).
Sh. Gaurav Mahindra provided a detailed comparison of the CRPC and the BNSS. The core of the discussion revolved around the procedural reforms introduced in the BNSS, especially in relation to arrest procedures. The BNSS brings significant changes in how arrests are made, emphasizing reforms that aim to enhance efficiency and fairness in the criminal justice system. The session delved into the powers of police during investigations and the jurisdictional aspects of courts under the BNSS framework. A crucial point discussed in the session was the issue of false First Information Reports (FIRs). Sh. Gaurav Mahindra explained how the BNSS incorporates stricter measures to address and penalize the misuse of FIRs, aiming to prevent malicious or baseless complaints.
The webinar conducted by Sh. Gaurav Mahindra offered an in-depth understanding of the differences between the CRPC and the BNSS. Attendees gained valuable insights into how the new law aims to reform various aspects of the criminal justice system, from arrest procedures to the handling of digital evidence and the accountability of law enforcement officers. The discussion was highly relevant for students and professionals in the legal field, providing clarity on significant changes that could impact their future careers.
